Who Owns Your Digital Clone?
Your contracts may already give others the right to build an AI version of you. Most creators have never checked.
A company can build an AI version of you that works for free. In most jurisdictions, that is legal.
This is not about deepfake scams. This is about the commercial exploitation of your likeness by legitimate companies operating within the gaps of contracts you already signed.
The legal framework around AI-generated likenesses has not caught up to the technology. Right of publicity laws (which protect your ability to control commercial use of your face, voice, and name) vary wildly by state and country. Some jurisdictions have strong protections. Many have almost none. And even where protections exist, enforcement against an AI model trained on publicly available data is untested territory.
The bigger vulnerability is the contracts you've already signed.
If you executed a brand deal that grants "use of likeness in perpetuity across all media now known or hereafter developed," a serious legal argument exists that AI-generated content using your voice and face falls within that grant. The language was written for TV reruns and banner ads. But "all media hereafter developed" is broad enough to drive a truck through, and AI-generated reproductions are the truck.
Think of it like signing a lease for an apartment, and buried in the fine print is a clause that lets the landlord replicate your furniture and rent out a copy of your unit to someone else. You agreed to it. You just did not know what you were agreeing to.
AI clause audit - Pull your last five contracts (brand deals, management agreements, platform terms). Search for these phrases:
"Likeness," "perpetuity," "all media now known or hereafter developed," "derivative works," "synthetic," "generated"
If any of those terms appear without an explicit carve-out for AI reproduction, flag it for your attorney
Sunset clause - Every new contract you sign should include explicit language: AI-generated reproductions of your likeness, voice, or persona require separate written consent and separate compensation. No blanket grants. No bundling it into the base fee.
Platform opt-out - Check every platform you publish on for AI training settings. Several major platforms now offer the ability to opt out of having your content used as training data. It's buried in settings. Go find it.
Your likeness is your most valuable long-term asset. Protect it the way you would protect a trademark, because functionally, that is what it is.
